Derechos de los niños, niñas y adolescentes y la importancia del abogado del niño en el fuero de familia

Abstract

En el presente trabajo de tesina se pretende hacer un análisis de los derechos de los niños, niñas y adolescentes en relación con su participación en los procesos judiciales. Por lo tanto se hará un recorrido en el derecho que tiene todo niño, niña y adolescente a ser oído frente a un juez, enmarcado dentro de los derechos fundamentales, y a ser representado por la figura del abogado del niño. Para llevar a cabo este objetivo, se propone realizar una investigación cualitativa de tipo analítico para realizar la revisión y el estudio bibliográfico y analizar las fuentes normativas que den cuenta del problema a partir de los elementos y características del fenómeno analizado, y las diferentes posturas doctrinarias.

In the present dissertation work it is intended to make an analysis of the rights of children and adolescents in relation to their participation in judicial processes.Therefore, a tour will be made of the right that every child and adolescent has to be heard before a judge, framed within the fundamental rights, and to be represented by the figure of the child's lawyer. To carry out this objective, it is proposed to carry out a qualitative analytical research to carry out the bibliographic review and study and analyze the normative sources that account for the problem based on the elements and characteristics of the analyzed phenomenon, and the different doctrinal positions.
